These Terms of Use (“Terms”) govern your access to and use of Tacoma Yacht Club's websites, member portal, online services, mobile services, and any successor or alternate domains operated on behalf of Tacoma Yacht Club (collectively, the “Website”).

“Tacoma Yacht Club,” “TYC,” “we,” “us,” or “our” refers to Tacoma Yacht Club.

By accessing or using the Website, you agree to these Terms. If you do not agree with these Terms, please do not use the Website.

1. Purpose of the Website

The Website provides information and online services relating to Tacoma Yacht Club and its activities, which may include:

Tacoma Yacht Club may restrict or terminate access to the Website when we reasonably believe these Terms have been violated.

3. Member Accounts and Restricted Areas

Certain portions of the Website may be restricted to Tacoma Yacht Club members or other authorized users.

If you receive login credentials, you are responsible for maintaining their confidentiality and for activity conducted through your account. You agree to promptly notify Tacoma Yacht Club if you believe your account or login credentials have been lost, stolen, disclosed, or compromised.

Member directories, contact information, vessel information, Club records, internal communications, and other information available through restricted areas are provided for authorized Club purposes.

Such information may not be:

• Copied or reproduced for unauthorized purposes
• Distributed outside authorized Club use

• Harvested or scraped
• Used for commercial solicitation
• Used to create mailing or marketing lists
• Used in any manner inconsistent with Club rules or these Terms

Access to a member-only area does not create any membership right beyond those provided by Tacoma Yacht Club's governing documents, rules, policies, or applicable law.

4. Account Eligibility and Minors

Member accounts and other restricted Website accounts may be created or used only by persons authorized by Tacoma Yacht Club.

Individuals under 18 should not independently create an account, submit agreements, or enter into transactions through the Website unless authorized by a parent or legal guardian and permitted by Tacoma Yacht Club's applicable program procedures.

Youth-program participation may be administered through a parent, guardian, or other authorized adult account.

Nothing in this section changes any age, eligibility, or parental-consent requirement established by Tacoma Yacht Club for a particular program or activity.

5. Club Rules and Governing Documents

These Terms govern use of the Website. They do not replace Tacoma Yacht Club's Articles of Incorporation, Bylaws, rules, regulations, policies, membership agreements, moorage agreements, program agreements, waivers, or other governing documents.

Members and guests remain subject to applicable Club rules and policies when using Club facilities, participating in Club activities, or receiving Club services.

If these Terms conflict with an applicable Tacoma Yacht Club governing document concerning Club membership, governance, facilities, member obligations, moorage, or program participation, the applicable governing document will control to the extent of that conflict.

6. Website Information

Tacoma Yacht Club makes reasonable efforts to provide useful and accurate information through the Website. However, Website information may occasionally contain errors, omissions, or outdated information.

Event dates, menus, prices, fees, hours, availability, moorage information, program details, rules, and other information may change without notice.

Information published on the Website should not be interpreted as modifying any contract, membership agreement, Club rule, Bylaw, waiver, or other governing document unless expressly stated otherwise.

7. Reservations, Registrations, and Transactions

The Website may permit users to:

• Make reservations
• Register for events or programs
• Submit applications
• Purchase goods or services
• Pay fees or charges
• Submit agreements or authorizations
• Conduct other Club-related transactions

8. Membership Applications

Information provided through the Website regarding Tacoma Yacht Club membership is for informational purposes and does not constitute an offer or guarantee of membership.

Submission of an application does not create membership rights.

Membership applications are subject to Tacoma Yacht Club's applicable Bylaws, policies, procedures, eligibility requirements, approvals, and other governing provisions.

9. Moorage and Marina Information

Information on the Website concerning slips, moorage, marina facilities, rates, availability, waiting lists, vessel requirements, or related services is provided for general informational purposes unless expressly incorporated into a written agreement.

Website information does not guarantee:

• Availability of moorage
• A particular slip assignment
• A reservation
• Placement on or priority within a waiting list
• Any other marina service or privilege

Moorage and marina use remain subject to applicable agreements, Club rules, policies, procedures, insurance requirements, and safety requirements.

10. Events, Sailing, Boating, and Recreational Activities

Boating, sailing, marina activities, races, cruises, training programs, and other recreational activities may involve inherent risks.

Participation in a particular activity may be subject to separate:

• Rules
• Eligibility requirements
• Waivers
• Releases
• Assumption-of-risk acknowledgments
• Safety requirements
• Insurance requirements
• Agreements

Nothing on the Website eliminates, replaces, or modifies any separate agreement, waiver, release, assumption-of-risk provision, or other requirement applicable to a particular activity.

11. Junior and Youth Programs

Information about junior sailing, youth activities, or other programs involving minors may be provided through the Website.

Registration and participation may require:

• Waivers or releases

13. Tacoma Yacht Club Name and Marks

The Tacoma Yacht Club name, logos, burgee, insignia, and other Club identifiers may be trademarks, service marks, or other protected intellectual property.

Nothing in these Terms grants permission to use Tacoma Yacht Club's name, logos, burgee, insignia, or other marks for commercial, promotional, endorsement, fundraising, merchandising, or other unauthorized purposes.

14. User-Submitted Content

If the Website allows you to submit photographs, videos, comments, documents, messages, or other content, you are responsible for ensuring that you have the right to provide that material.

You may not submit material that:

• Violates another person's intellectual property rights
• Violates another person's privacy or publicity rights
• Is unlawful, threatening, defamatory, fraudulent, or intentionally misleading
• Contains malicious software or harmful code
• Violates applicable Tacoma Yacht Club rules or policies

Submission of content does not obligate Tacoma Yacht Club to publish, retain, or distribute it.

By submitting photographs, comments, documents, videos, or other content to Tacoma Yacht Club through the Website, you grant Tacoma Yacht Club a non-exclusive, royalty-free license to use, reproduce, display, and distribute that content in connection with Club purposes, including the Website, Club publications, newsletters, displays, archives, and Club social-media accounts.

You may request that submitted content be removed from active Club publication at any time. Tacoma Yacht Club will make reasonable efforts to honor such a request, although copies may remain in archives, historical publications, backups, or materials that cannot reasonably be recalled.

You are responsible for maintaining a valid email address or other electronic contact information when required for a transaction.

You may retain copies of electronic records for your files.

Nothing in this section requires Tacoma Yacht Club to offer every transaction electronically.

Tacoma Yacht Club respects the intellectual property rights of others.

If you believe material available through the Website infringes a copyright you own or control, you may contact Tacoma Yacht Club and provide sufficient information to identify the copyrighted work, the allegedly infringing material, your contact information, and the basis for your claim.

To the extent permitted by applicable law, you agree to indemnify and hold harmless Tacoma Yacht Club and its officers, trustees, directors, employees, volunteers, agents, and representatives from claims, damages, liabilities, costs, and expenses arising from:

23. Suspension or Termination of Website Access

Termination of Website access does not by itself determine or alter a person's membership status unless action is separately taken pursuant to Tacoma Yacht Club's applicable governing documents.

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles.

To the extent permitted by applicable law, any dispute arising specifically from use of the Website that is properly brought in court will be brought exclusively in the Superior Court of Washington for Pierce County or the United States District Court for the Western District of Washington, as applicable.

If an applicable Tacoma Yacht Club Bylaw, membership agreement, moorage agreement, waiver, or other governing document contains a valid dispute-resolution requirement applicable to the dispute, that provision will control to the extent of any conflict with this section.

25. Changes to These Terms

Tacoma Yacht Club may update these Terms periodically to reflect changes in the Website, services, Club operations, technology, or legal requirements.

Revised Terms will be posted on the Website with an updated “Last Updated” date.

Your continued use of the Website following the effective date of revised Terms constitutes acceptance of the revised Terms to the extent permitted by law.

26. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

27. No Waiver

Tacoma Yacht Club's failure to enforce a provision of these Terms does not constitute a waiver of that provision or any other provision.
